Rent Collection and Payment Policies
Rent has to come in on time in order for you to remain profitable, so your lease must clearly define how, when, and where it’s paid. The details we include in every lease include:
Rather than simply stating the rent is due on the first of the month, it’s wise to specify a specific time and date that it’s due, for example by 9:00 p.m. on the first of the month. Include a clearly defined grace period, if any, and be specific about what constitutes a late payment. This helps avoid disputes over when late fees may be charged.
In California, late fees must be a reasonable estimate of costs incurred due to late payment, not a penalty. Your lease should set a specific dollar amount or percentage and tie the fee to the timing so tenants know exactly when they’ll be assessed.
Maintenance, Repairs and Landlord vs. Tenant Responsibilities
A solid and detailed lease agreement addresses property condition, repair obligations, and how issues are reported and resolved. Differentiate between routine maintenance such as faucet leaks or appliance issues and emergencies such as gas leaks, fires, and flooding.
Tenant reporting procedures must be clear. Specify how tenants must report maintenance issues, whether you want to hear about them by email, online portal, or written notice. Maybe you want to be called for emergencies.
Clarify tenant obligations. These might include keeping the property clean and free of pests, changing HVAC filters regularly, and reporting repair issues promptly. Some rental property owners want their tenants to take care of landscaping and yard care. That’s fine, just make sure it’s in the lease and your residents are aware of the responsibility.
Legal Compliance: Oakland and California Tenant Laws
Oakland landlords must navigate municipal, state, and federal tenant protections. A lease agreement should reflect compliance and indicate when exemptions apply. We say this because Oakland’s local ordinances provide strong tenant protections, including:
- Limits on rent increases
- Just cause eviction requirements
- Relocation assistance in some cases
What’s important is that not all rental properties in Oakland are covered by these protections. Exemptions may include newly constructed buildings, single-family homes, and duplexes in which the owner occupies one of the homes. Your lease should clearly state whether the unit is covered under local rent/eviction protections and cite the specific ordinance or exemption. Including this language reduces confusion and can provide legal protection should disputes arise. If your property is exempt and your lease does not reflect that, you could lose the exemption. That’s what we mean about details being so essential.
Security Deposits in Oakland
Security deposits are governed closely by California law, and Oakland landlords must ensure lease language is consistent with statutory limits and timelines.
- Deposit Limits. In California, you cannot charge more than the equivalent of one month’s rent as a security deposit for most properties. Let your lease cite this limit and the amount that you are collecting for your property.
- Describe legitimate uses of the deposit, which will include unpaid rent, damage beyond normal wear and tear, and cleaning costs.
State law requires deposits be returned within 21 days of vacancy. The lease should state this and note that an itemized list of deductions will be provided.
Pet Policies: Fees, Deposits Restrictions
Renters in Oakland really love their pets. And, if you’re renting out a pet-friendly home, you’re likely going to benefit from lower vacancy times, higher rents, and more committed, long-term tenants. One thing to remember is that state and federal protections for service and emotional support animals are strict. They’re different from pets. But pet policies (and associated fees) are still enforceable with proper language in the lease.
Spell out whether pets are allowed, if you have any breed, weight, or age limits, and if there is any additional pet rent or pet fees that are collected. Avoid language that contradicts local laws regarding service animals. Be clear that tenants are responsible for damage caused by pets.
Rules, Regulations, and Standards of Conduct
A lease should establish standards of behavior and community expectations. Ideally, you won’t have to worry about any bad behaviors or confrontations. But if there is a dispute between tenants or a resident who is consistently playing their music too loud, you and your tenants will turn to the lease agreement first for guidance on how to proceed. We recommend language that covers:
- Noise & Nuisance. Include language prohibiting disturbances and outline potential consequences.
- Smoking and Vamping Policies. If you restrict smoking, state where it’s prohibited and any penalties.
- Parking and Common Areas. Clarify how parking is assigned and rules for common spaces.
Don’t forget to talk about subletting in your lease. Many landlords overlook this until it becomes a problem. If you’re going to allow subletting, you want to require tenants to see written permission. You can also set reasonable standards, such as credit qualification or background checks for subtenants.
